Arif (hereinafter referred to as the "Association") has provided me with the Information Notice, which explains in detail and in an understandable manner the categories of personal data to be processed, the specific personal data to be processed, the purposes of processing, the parties to whom the data may be transferred, the methods of collection, the legal grounds, the identity of the data controller, and my rights. I confirm that I have read and understood the aforementioned Information Notice.

In accordance with the relevant provisions of the Law on the Protection of Personal Data No. 6698 ("KVKK"), I acknowledge that I have been adequately informed by the Association about the processing of my personal data as outlined in the KVKK, as well as the Information Notice prepared in compliance with the decisions of the Personal Data Protection Board and relevant legislation. I understand and consent to the processing, recording, and use of my personal data and my child's data (such as user name and surname, Turkish ID number, IBAN, email, address, phone number, company name if a tax registrant, tax ID number, tax office, primary activity code) by the Association for the purposes of:

  • Providing and improving its products and services,
  • Utilizing in marketing and advertising,
  • Conducting audits, data analysis, and statistical studies,
  • Managing relationships with business partners,
  • Carrying out necessary operations by the relevant business units for commercial activities,

I also consent to the transfer of my and my child’s personal data to Payment and Electronic Money Institutions and Rivanti Software Company, as well as the retention of this data by the Association within the legal timeframes prescribed by law in situations where the legitimate interest of the Association applies.

INFORMATION NOTICE UNDER THE LAW ON THE PROTECTION OF PERSONAL DATA NO. 6698

At Arif ("Association"), ensuring the confidentiality and security of your personal data is among our highest priorities. In this regard, and in compliance with Article 10 of the Law on the Protection of Personal Data No. 6698 (“KVKK” or “Law”), we would like to inform you about the processing of your personal data. Below, you will find information regarding the personal data processed by our Association, the purposes of its processing, the recipient groups to whom the data may be transferred, the method of collection, the legal basis, and your rights concerning such data.

For What Purposes Do We Collect Your Personal Data?

Your personal data, collected in accordance with the fundamental principles prescribed by the Law and the conditions and purposes for processing personal data set out in Articles 5 and 6 of the Law, may be processed by the Association for the following purposes:

  • Preparing and sending member-specific promotions, announcements, campaigns, and notifications, and communicating changes related to the use or payment terms of products and services,
  • Conducting customer surveys, implementing customer satisfaction practices, and providing related information,
  • Using data in audits, data analysis, research, statistical studies, understanding trends, and in marketing and advertising services,
  • Performing necessary work and executing business processes through relevant business units to carry out the Association’s commercial activities,
  • Planning and executing the Association's commercial and business strategies,
  • Ensuring the legal, technical, and commercial/operational security of the Association and individuals with whom it maintains business relationships,
  • Fulfilling contractual obligations and complying with legal obligations arising from applicable legislation,

What Personal Data Does the Association Process?

  • Identity Information: Your first name, last name, Turkish ID number, date of birth, and other information provided with your explicit consent to the Association.
  • Contact Information: Your mobile phone number, email address, and physical address.
  • Financial Information: Details related to payments and payment methods.
  • Customer Transaction Information: Your purchase/order history, order details, number of orders, invoice details, requests/complaints, reviews, ratings, and feedback.

How and Through Which Channels Do We Collect Your Personal Data?

Your personal data is collected through the following methods:

  • Membership Forms: Information is gathered from membership registration forms or online application forms submitted via the Association's official email address, [email protected], or other official email addresses of the Association.

  • Documents Submitted During Membership Registration: During the registration process, the Association may request documents such as a copy of your ID card, proof of address (e.g., a residence certificate or utility bill), bank/IBAN details, and links to social media accounts or websites from membership or user candidates.

  • Physical Means: Data may also be collected by sending physical documents or filling out forms provided by the Association, as well as by calling the Association's official phone line (08508401139) or other internal numbers.

  • Automated Means: Your personal data is also collected automatically via the Association’s website (https://arif.org.tr/ and its subdomains) through application forms, surveys, and essential cookies.

Legal Basis for Personal Data Processing

The Personal Data Protection Law (KVKK) lists the conditions for processing personal data in its 5th article, 2nd paragraph. If the purposes for processing personal data by a data controller can be evaluated within the personal data processing conditions listed in the KVKK, the data controller may process personal data in a lawful manner. In this context, the personal data processing activities carried out by the Association are conducted only if the purposes for processing are within the legal conditions defined by the KVKK. The Association does not engage in any personal data processing activities that fall outside the scope of the KVKK conditions.

The personal data processing conditions listed in the KVKK are as follows:

  • The data subject’s explicit consent.
  • Explicit provision in the law.
  • Necessity for the protection of the life or physical integrity of the person or another, where the person is incapable of giving consent due to physical impossibility, or where their consent is not legally valid.
  • Necessity for processing personal data directly related to the establishment or performance of a contract.
  • Necessity for the data controller to fulfill its legal obligation.
  • The data has been made public by the data subject.
  • Necessity for processing personal data to establish, exercise, or protect a right.
  • Necessity for processing personal data for the legitimate interests of the data controller, provided that the fundamental rights and freedoms of the data subject are not violated.

Who Do We Share Your Personal Data With?

Your personal data is shared with authorized public institutions and organizations, judicial authorities, enforcement agencies, law enforcement agencies, contracted suppliers, business partners, and consultants for the purposes and means outlined in this Disclosure Statement.

Personal data may also be shared with consultant organizations that cooperate with the Association, limited to the scope of their activities related to the services they provide that complement the Association's activities.

The Association does not share any data unrelated to its purposes. For example, even if we obtain information such as your vehicle license plate number with your consent, it will not be shared with any third parties, including the organizations mentioned above, unless required by law or necessary for a criminal investigation, or requested by an official authority based on legislation and with justification.

Your Rights

It is important that the personal data we hold about you is accurate and up-to-date. Therefore, please inform us if there are any changes in your personal data. Otherwise, we would like to inform you that we will not be responsible for any inaccuracies in the data we hold in our systems. Except in cases specified under Article 28 of the KVKK "Exceptions," your rights under Article 11 of the Law are as follows; you can apply to our Association to:

  • Learn whether your personal data is processed.
  • Request information about your personal data if it has been processed.
  • Learn the purpose of processing your personal data and whether it is being used in accordance with that purpose.
  • Know the third parties to whom your personal data has been transferred, both domestically and internationally.
  • Request correction of any incomplete or inaccurate personal data.
  • Request the deletion or destruction of your personal data under the conditions specified in Article 7 of the Law.
  • Request the notification of the correction, deletion, or destruction of your personal data to third parties to whom it has been transferred, both domestically and internationally.
  • Object to the result of the analysis of your personal data solely through automated systems, if it leads to a negative outcome, and request compensation if you suffer damage due to unlawful processing of your personal data.

How to Exercise Your Rights

You can fill out the "Application Form" based on your request/complaint and send it to us via email at [email protected], or you can physically fill out the form and send it by cargo/post to the address: Gazi Umur Paşa Sokak 32/14 Beşiktaş/İstanbul.

If you submit your request using one of the methods above, your request will be evaluated and responded to within 30 days, as per Article 13/2 of the KVKK. If your request is accepted, the necessary actions will be immediately taken by the data controller, the Association.

As a general rule, requests will be processed free of charge, but if fulfilling the request requires costs, a fee may be charged as per Article 7 of the "Regulation on the Procedures and Principles for Applications to the Data Controller." If the written response to the application exceeds 10 pages, a processing fee of 1 TL per page may be charged. If the response is provided on a CD, flash drive, or similar storage medium, the fee cannot exceed the cost of the storage medium.

DONATION AGREEMENT

Introduction
The vision of Arif Association is to provide continuous and quality support to international Non-Governmental Organizations (NGOs) operating on the global stage to enhance their effectiveness and efficiency in education, human resources, communication, transportation, and logistics. Through this support, the Association aims to facilitate the achievement of these organizations' global goals and contribute to the valuable work they do for humanity.

The mission of the Association is to assist organizations operating in various cultures and geographies around the world by providing them with necessary resources and thus creating a global network of collaboration and support, aiming to have a positive impact wherever the sun rises and sets.

The Association provides support solely to international NGOs that serve humanity based on the responsibility laid upon us by our religion, history, and geography, without any political or material expectations, in the fields of education, human resources, communication, transportation, and logistics.

Definitions
In this policy, the following terms are defined:

  • In-kind Donation: Donations of goods, rights, and services, other than monetary donations.
  • Food Donation: Donations made to provide hot and nutritious meals to those in need.
  • Water Well Donation: Donations made for the construction of water wells in regions in need.
  • Sacrifice Donation: Donations related to sacrifices made in the field.
  • Educational Support: Donations made to provide equal educational opportunities and a bright future for thousands of children.
  • Monetary Donation: Donations made in Turkish lira, foreign currency, or valuables such as gold and silver, which can easily be converted into cash.

Purpose
The purpose of this policy is to guide the Arif Association in carrying out its donation acquisition activities in line with its strategic goals, strengthen relationships with donors and the public, ensure that donations reach the institution in a fast, easy, and reliable manner, and establish fundamental approaches in accordance with transparency, accountability, ethics, and legal rules.

Scope
The Arif Association's Donation Agreement includes the collection, recording, protection, monitoring, evaluation, organization of donation campaigns, implementation of projects, collaborations, and transparent and accountable presentation of donation usage information to donors and the public for educational support, water wells, food donations, sacrifice donations, and all types of monetary and in-kind donations.

This policy applies to the members, administrators, employees, volunteers, donors, beneficiaries, researchers, suppliers, business partners, and all third parties interacting with the Arif Association. The Association collaborates with individuals, institutions, and organizations that act in compliance with this policy.

Donation Policy

  • Proper Use of Donations: The donations collected will be used according to their intended purpose.
  • Reaching Those in Need: The organization will provide assistance to those in need in both national and international settings in a timely and effective manner.
  • Transparency: All donation activities will be conducted transparently, and information will be shared regularly with donors.
  • Data Protection: The organization will ensure the protection of personal data, in compliance with the Personal Data Protection Law (KVKK).
  • Campaigns and Collaborations: Campaigns may be organized to increase awareness and raise funds. The organization also cooperates with national and international organizations to enhance resource mobilization.
  • Respect for Human Dignity: The organization will not accept donations of used food, hygiene, consumable products, or medications unless it is an emergency situation. In such cases, damaged items will either be destroyed or recycled.
  • Prohibited Donations: The organization will not accept donations from entities involved in human trafficking, terrorism, or the financing of mass destruction weapons.
  • Secure Donation Methods: Donations can be made through a secure online platform. Donations are voluntary and will be transferred to the organization’s account as general donations.

Refund Conditions

  • Eligibility for Refund: If a donor wishes to cancel a donation, they must notify the organization within 7 days from the donation date, excluding any payments for slaughtered animals or distributed fitre.
  • Refund Procedure: The refund request should include specific information (donation date, amount, name, etc.) sent either by post or email. If not received, the cancellation request will be considered invalid.
  • Conditions for Refund: If the donation is canceled, the donor must cover any shipping costs for the return of products, if applicable. If the donation is of a non-returnable nature or is diminished in value, the organization has the right to refuse a refund.

General Terms

  • Jurisdiction: In case of disputes, Istanbul courts have jurisdiction.

For these purposes, personal data may also be transferred abroad in compliance with the procedures specified in Article 9 of the Law and in accordance with the decisions of the Personal Data Protection Board.
